MORNING BLEND OFFICIAL RULES FOR VARIOUS ON AIR AND WEB BASED CONTESTS

The following rules apply in contests or promotions associated with KGUN9-TV, which is owned and operated by the Journal Broadcast Group, Inc.  By participating in any such contests or promotions, participants agree to be bound by these rules.  In addition, particular contests and promotions may have rules that are specific to those contests or promotions.  If the particular rules for a specific contest or promotion conflict with the following general rules, the particular rules will control.

1.            HOW TO PLAY:  No purchase necessary.  Void where prohibited.    Watch KGUN9-TV, Channel 9 On Your Side, during various broadcasts as announced on air.  When viewers are instructed to call in and win, simply be the appropriate number of callers and you will win the prize mentioned in the giveaway.

2.            ELIGIBILITY: 

A.            Open only to legal residents of Nevada, California and Arizona within the Channel 9 viewing area.    All winners must be 18 years of age or older to participate.  Some contests require winners to be at least 21 years old to participate.  To claim your prize you must present ID at the KGUN Studios.  One must be a legal Drivers License or other “official” type of ID issued by a government agency.  This piece of ID must include a picture photo of yourself and your birth date.  An alternative could be a Birth Certificate if you also have another acceptable form of ID that includes your picture.  If you fail to produce proper identification, your prize will be forfeited.   Employees of KGUN9-TV, Journal Broadcast Group, our sponsor, their parent, subsidiary and affiliated companies, advertising and promotion agencies and anyone involved in this contest production, development or handling, and immediate families/household members of anyone so employed are not eligible.

            B.            Entrants are required to provide truthful information and Promoter will reject and delete any entry that it discovers to be false or fraudulent.  Promoter will disqualify any entry from individuals who do not meet the eligibility requirements, and Promoter will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

ENTRY

To participate in the Promotion, you may enter via the following method(s):

VIA INTERNET – Enter using the sign up form at TUCSONMORNINGBLEND.COM.  Follow the links and instructions to enter and submit your first name and last name, complete address, city, state, zip code, telephone number and a valid email address in the online entry form.  Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry.  The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning the email address or the domain associated with the submitted email address.  Multiple entrants are not permitted to share the same email address.  All entries submitted become the sole property of the Promoter and will not be acknowledged or returned.  Use of any device to automate entry is prohibited.  Proof of submission of an entry shall not be deemed proof of receipt by Promoter. The contest administrator’s computer is the official time keeping device for the Promotion.  For purpose of this Promotion, a “Day” shall begin at 12:00:00 a.m. PT and shall end at 11:59:59 p.m. PT.

VIA POSTAL MAIL – As an alternative send your name, complete address and phone number to KGUN9-TV, 7280 East Rosewood St., Tucson, AZ  85710. 

Only one entry per person, per contest will be accepted. Each person can only win one time during the promotion. All entries must be received by KGUN9 TV by 11:00AM PDT on the date specified in the contest.

3.            PRIZES and ODDS:  Odds of winning a contest are dependent upon the number of eligible entries received.  KGUN9-TV and Journal Broadcast Group, Inc., their subsidiaries and affiliates and their respective directors and employees are not responsible for any error, omission, interruption, deletion, malfunction, defect or delay of any kind in telephone calls, radio transmissions, or on-line or internet submissions or for the failure of KGUN-TV to receive telephone calls for any reason or for any computer or software malfunction of any kind affecting the proper execution of any contest.

4.            WINNERS:  Winners are chosen in various ways depending upon the contest.  Some will be the correct caller, some randomly in drawings, some with correct information.  The winner will be directed when and where to pick up their prize by either phone or letter.

5.            CONDITIONS

a.            Payments of all federal, state and local taxes are solely the responsibility of the winners.  Winners will be required to complete and submit an IRS Form W-9 or the equivalent including the winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by Promoter in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.

b.            By participating in the Promotion, each winner agrees to have his or her name, city, state, voice, or likeness used in any advertising or broadcasting material relating to this Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c.            Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the contest, the Promoter in its sole discretion will require verification of Promotion winner’s identification by a showing of valid government-issued photo identification.  By participating in the Promotion, each winner agrees to release hold Promoter, its sponsor(s) and promotional partner(s), and each of their parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents and representatives of each of them (collectively, the “Released Parties”) harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Promotion.  Promoter will also require eligible Promotion winners and their guests or travel companions, if any (as well as each of their parent(s) or legal guardian(s), if winners, guests or travel companions are under the age of majority in their state of residence), to sign a liability release confirming such consent.

d.            Promoter, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or the operation of Promoter’s web channel or is otherwise in violation of the rules.  Promoter further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Promotion, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Promoter’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by Promoter in is sole discretion.  Any attempt by an entrant or any person to deliberately damage any Promoter web channel or to undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws.  Should such an attempt be made, Promoter reserves the right to seek full prosecution and/or damages from any such individual to the fullest extent permitted by law.  Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision.  If due to circumstances beyond the control of Promoter, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, Promoter reserves the right, but not the obligation, to modify, suspend or cancel the Promotion and shall not be required to award a substitute prize. 

e.             The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals; or (iii) lost, stolen, mangled, misdelivered, postage due, illegible, incomplete, incorrect, or late entries.

f.            To obtain a copy of the Official Rules or a list of winners following completion of the Promotion (please specify which), send a self-addressed, stamped envelope (VT residents may omit return postage) specifying “Official Rules” or “Winner List” to:  Winner List or Official Rules Request, KGUN9-TV, 7280 E. Rosewood St., Tucson, AZ  86710.  A copy of the Official Rules and a list of winners (when complete) are also available during regular business hours at the KGUN9-TV offices at the address listed above.   All such requests must be received within thirty (30) days following completion of the Promotion.

6.            OTHER:  If for any reason a prize is not claimed or winner is disqualified, the prize will be forfeited.  Winners have 30 days from the date of winning to claim their prize.  If not claimed within 30 days, the prize will be forfeited.   If for any reason the contest is not capable of running as planned, including tampering, unauthorized intervention, fraud, technical failure or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the contest,  KGUN9-TV and it’s sponsors reserve the right at their sole discretion, to modify, cancel, terminate, and/or suspend the contest and to disqualify any individual who tampers with the entry process, violates these official rules, or acts in a disruptive manner.  By participating, entrants agree to be bound by these official rules and the decision of the sponsors and the judges, which shall be final in all respects.  Any non-compliance with rules or conditions will result in disqualification.

7.            Where a prize consists of tickets for a sporting event, concert, movie, play or similar event, KGUN will not be responsible for cancellation.  In that event, the winner must deal exclusively with the promoter of the event. 

8.            As a licensee of the FCC and trustee of the public airwaves, KGUN-TV reserves the right to interrupt and/or discontinue any contest or promotion (and not award the offered prize) at the discretion of KGUN-TV management if world events, the national mood, or public safety so warrant. 

9.            KGUN-TV reserves the right to amend the rules to any contest at any time. 

10.             The decision of KGUN-TV management is final.
